These Terms of Use ("Terms") apply to the Wild Traffic mobile game ("the App") published by Odd Penguin Games ("we", "us"). By downloading or playing the App, you agree to these Terms. If you don't agree, please don't use the App.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial entertainment. If you downloaded the App from the Apple App Store, this license is also subject to Apple's Licensed Application End User License Agreement. If you downloaded it from Google Play, Google Play's terms also apply.
2. What you may not do
- Copy, modify, reverse engineer or redistribute the App or its content, except where the law allows it
- Use cheats, hacks, bots or exploits, or interfere with the App's operation
- Use the App for any unlawful purpose
3. Virtual items and in-app purchases
The App may include virtual items such as coins, gems, stars or vehicles. These items have no real-world value, cannot be exchanged for money, and are licensed to you, not sold. We may change or remove virtual items as the game evolves. Any real-money purchases are processed by Apple or Google under their terms, and refunds are handled by them. Game progress is stored on your device and may be lost if you delete the App or change devices.
4. Ownership
The App, including its code, art, music, characters and levels, belongs to us or our licensors and is protected by intellectual-property laws. Third-party components are used under their own licenses.
5. Privacy
Our Privacy Policy explains what data the App collects and how it is used.
6. Updates and availability
We may update, change or discontinue the App or any part of it at any time. Some updates may be required to keep playing.
7. Disclaimer
The App is provided "as is" and "as available", without warranties of any kind, to the fullest extent allowed by law. We don't promise the App will be error-free or uninterrupted.
8. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data or game progress, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim, or US $10 if you paid nothing. Some places don't allow these limits, so they may not apply to you.
9. Termination
Your license ends automatically if you break these Terms. You can stop using the App at any time by deleting it.
10. Apple-specific terms
If you use the App on an Apple device: these Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any product, intellectual-property or other claims relating to the App. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.
12. Changes to these Terms
We may update these Terms. When we do, we'll change the effective date above. Continuing to use the App after changes means you accept the new Terms.
